This website (“Website”), located at www.catchyandcrew.com domain name (the “Website”), is published and maintained by Catchy Kids Pty Ltd (“Catchy”) in Sydney, Australia.
By accessing and using the Website, and/or using the products or services offered on or through the Website (the “Services”), you agree to this Privacy Policy as it may be amended from time-to-time and to the collection, use and disclosure of personal information by Catchy as set out in this policy.
Intellectual Property:
Intellectual property includes but is not limited to all rights in respect of an invention, discovery, trade secret, secret process, know-how, concept, idea, information, process, data, formula, or work product. Catchy owns all intellectual property rights in the products and company branding as between you and us and claims all present and future rights to intellectual property including inventions and improvement, trademarks (whether registered or common law trademarks), patents, designs, copyright, and corresponding property rights under the laws of any jurisdiction.
Confidentiality and Personal Information:
Personal information is information or an opinion about an individual whose identity is apparent, or can be reasonably ascertained, from that information or opinion. Personal information we may collect from you includes, without limitation, your name, address, email address, telephone number(s) and date of birth.
Catchy will collect personal information only by lawful and fair means and not in an unreasonably intrusive way. If it is reasonable and practical to do so, Catchy will only collect personal information about you directly from you. Catchy will not collect personal information unless the information is necessary for our functions and activities.
Catchy will handle all personal data with due care. By providing your personal data, you give your consent to our use of the data gathered to meet our obligations towards you, and to provide you with the service you expect. This may include delivering the goods you have ordered, sending information about Catchy, and other offers for marketing purposes. If any problems arise when we deliver products to you, or with products you have purchased, we will use the data to contact you. Catchy monitors and processes your personal data in accordance with applicable data protection legislation.

At any time you may opt out of receiving any communications from us (other than as required for our primary purpose or by law). Unless you opt out, your consent to receive communications from us and to the handling of your personal information as detailed above, will continue. Content or material that you upload or send to Catchy in some other way:
By sending content to Catchy, e.g., text, photography, videos and other images, you grant Catchy a non-exclusive licence itself or via another party without limitation and using all technologies and media, and in all forms, to use the material throughout the world. You also accept that Catchy may alter and edit the material so that it can be used as Catchy considers appropriate. You may revoke this licence at any time by notifying Catchy of this. When you revoke the licence, Catchy must stop using the material as soon as possible, and not later than within three months. However, Catchy is under no obligation to recall material that has already been distributed.
You may only send content to Catchy to which you are entitled. By sending the material to Catchy, you confirm that you are entitled to grant Catchy the licence in accordance with the preceding paragraph, that Catchy has no liability for the material that you have sent, and that you will hold Catchy harmless and compensate Catchy for all loss, injury or damage that Catchy may incur as a result of its use of the material, provided that Catchy uses the material in accordance with the above licence.
Direct Marketing:
We may use personal information about you for the primary purpose of providing you with our services, and for other purposes for which you would reasonably expect us to use that information. This includes sending you information about new developments, products, services and special offers by post, telephone or any form of electronic communication including SMS. You authorise us to use any email address or other contact information you provide to us at any time for this purpose.
You can, at any time, opt out of receiving marketing material by contacting us. You agree and acknowledge that even if you opt out of receiving marketing material, we will still send you essential information that we are legally required to send you relating to the goods and services we provide. Once you opt out of receiving marketing material from us, you agree and acknowledge that this removal from our distribution lists may take several business days after the date of your request for removal.
If you wish to withdraw your consent for us to send you marketing communications, you can do this as follows:
- to withdraw consent for marketing emails - by clicking on the ‘Unsubscribe’ or otherwise following the steps provided in the email;
- to withdraw consent for marketing SMS - by following the steps provided in the SMS; or
- by contacting us and requesting to withdraw consent for marketing SMS at hello@highchaircatchy.com
Once we receive notification that you wish to withdraw your consent for receiving marketing communications, it may take up to five (5) business days for your withdrawal to be reflected in our systems. Please note you may still receive marketing communications during this period.

If you are in the EU or UK, the following applies in addition to the rest of this policy.
Lawful basis. We process your personal data to perform our contract with you (orders, support, shipping), to comply with legal obligations (tax, accounting), with your consent (marketing, non-essential cookies), and for our legitimate interests (fraud prevention, improving our service and products).
Who we share data with. We share your data with categories of recipients including our e-commerce platform, payment processors, shipping providers, marketing and analytics providers, customer support providers, and professional advisers. International transfers. Some of our providers are based outside the EU/UK, including in Australia and the USA. Retention. We keep your personal data for as long as we have a legitimate need to do so, including to provide our services, comply with our legal and tax obligations, defend legal claims, and maintain our relationship with you. When we no longer need it, we will delete or anonymise it.
Your rights. You have the right to access, correct, delete, restrict or object to processing of your personal data, to data portability, and to withdraw any consent you have given.
